    On the other hand, many consumer advocacy groups believe affiliate guidelines are still not strict enough. The real problem arises when marketers try to game the system or blatantly ignore the rules. So, no, it’s not a wholesale government conspiracy against affiliate marketers, but it’s definitely a watchful eye that will come down hard on bad actors.

    • Place a clear affiliate disclosure: This could be at the beginning of a blog post, in the description of a YouTube video, or verbally in a podcast.
    • Don’t bury the disclosure in a sea of text or legalese.

    When in doubt, disclose. It’s better to be overly transparent than to have FTC knocking at your door.

    Learning what not to do can be as valuable as knowing the right way. Here are four practices that can get you slapped with penalties, lawsuits, or a tarnished brand name…and sometimes all three! Either way, non-compliance can hamper your brand-building efforts.

    Cookie stuffing happens when you secretly place affiliate cookies on a user’s device, so you’ll earn commissions if they buy the product, even if they never clicked on your actual affiliate link intentionally.

    It’s bad because it’s fraudulent, deceives advertisers, and robs other affiliates who do legitimate promotions. It also destroys consumer trust.

    Click Fraud

    Click fraud happens when you generate fake clicks (via bots or paid users) to inflate ad revenue or sabotage a competitor’s ad budget.

    It drains advertiser funds unfairly and distorts conversion data. It can also get you blacklisted from major ad networks like Google.

    Typosquatting/URL Hijacking

    Typosquatting happens when you register domain names similar to well-known brands (e.g., “amazzon.com”) to trick people into visiting your site.

    It’s a deceptive practice that’s very frowned upon. You’re essentially stealing traffic that was intended for a trusted brand, which erodes trust in the entire affiliate marketing ecosystem.

    Mystery Shoppers

    Mystery shoppers refer to the practice of hiring or impersonating fake buyers who meet the advertiser’s requirements just so you can pocket a commission.

    It undermines legitimate business practices and can lead to contract breaches and possibly criminal charges if you’re forging documents or using stolen info.

    Now that you know what not to do, let’s talk about the consequences of breaking these rules. Spoiler alert: they’re not pretty.

That’s not even the worst thing about being caught non-compliant.     Promoting products honestly doesn’t just help you stay compliant, it also builds trust with your audience. The best way to make honest promotions is to test the products before promoting them. If you can’t personally test them, be transparent about how you’re sourcing your information or reviews.

    You should also avoid exaggerations. Instead of saying, “This plugin guarantees you’ll become a millionaire in 30 days,” opt for data-backed claims like, “This plugin helped me increase my email sign-ups by 25% over a month.”

    It’s surprising how often people skip this. Having a contact page (and form) signals you’re a real person or business.

    • What to include:
      • Your email address.
      • Physical mailing address (if applicable).
      • Optional phone number (helpful but not mandatory).

    Some ad platforms require you to have a contact page for approval. It also boosts credibility because readers can reach out for questions or concerns.

    Affiliate Disclosure

    A dedicated page (or prominent note in each piece of content) explaining that you earn a commission from certain product links.

    • What to include:
      • A simple explanation that some (or all) of your links are affiliate links.
      • Clarification that the purchase price doesn’t change for the buyer.
      • A friendly, honest tone. For example, you can say: “If you click on my affiliates/advertisers links, I am going to receive a tiny commission. The products that I advertise are the ones I believe in.’”

    There’s no solid format for affiliate disclosure, so you can write your own as long as the message comes through

    Privacy Policy

    This is a legal requirement in most jurisdictions if you collect personal data.

    • What to include:
      • Details on what information you collect (email addresses, cookies, etc.).
      • How you use that information (newsletter sign-ups, retargeting ads, etc.).
      • Whether you share that info with third parties (e.g., email marketing platforms).

    You can start with a template from reputable sites or privacy policy generators, but always tailor it to your specific data usage.

    It can feel like a chore to wade through legal documents and disclaimers, but here’s a metaphor to help reframe your mindset: Think of compliance as the sturdy guardrails on a winding mountain road. Sure, it can feel restrictive to have guardrails there. Yet they’re the very things that let you drive confidently without fear of plummeting off a cliff.

    When you put effort into compliance, you’re showing your audience (and potential advertisers) that you’re serious about treating them fairly. And guess what? That fosters loyalty, which can translate into long-term success far beyond a quick affiliate payday.
